again, my name is Alicia harworth. I am an escrow officer at ticore title. I personally am a mom of three. Have been a Vegas residence for 30 resident for 30 years. I'm originally from California. My career background is I used to be in the beauty industry four year for a few years, and then I went to college for business, did a little career switch, met the president of our company, and she hired me in escrow, and I've been here since so I've been an escrow officer for 13 years, and are in escrow for 13 years and an escrow officer for four years. a title company is a disinterested third party. We work with all parties of the transaction, the buyers, sellers, real estate agents, attorneys, any lenders, any CPAs, anybody, any professional that has to deal with real estate, has to go through the Title and Escrow Company. We're the middle man for everything. My job is to make sure the transaction is illegal. The seller has authorized, is authorized, to sell the property, and the buyer walks away with a property and the home with no pass liens and judgments, no outstanding balances, and they get the property free and clear, no clouds on title. All documents are signed through me. All money comes through me, and all money is dispersed through me.

Um, there's a lot of stories that I could go over, but time wise, I'm just going to give you a positive one that recently happened. We had a 65 year old man was buying a house, and his wife had passed away two years ago, and it was his dream. It was their dream, to buy a home, and now he's finally able to do it. He had a real estate agent approach him, talk to him about you're not too old to buy a house in the signing, he brought his wife's picture so they could be together, and he cried during the signing. We took pictures, and it was a beautiful moment. And it's stories like that is why I do what I do. When I get frustrated in my job. What keeps me going is meeting someone like that and stories like that. And I'm sure you can relate being a real estate agent, but yeah, that's a beautiful story that I had today.

Wow, that's gonna make me tear up right now. That's really, really a great story. And yes, I do have had moments where I've had those heartfelt moments with my clients also. And what are some true, scary, let's say scary stories you can share with the listeners. Alicia, well, switching

that over to scary, let's see one time we had a lady who changed her name. We'll call her Jane Johnson. She the owner of the of a $1.8 million property's name was Jane Smith. Jane Johnson changed her name to Jane Smith, and has been trying to sell this property for years. She's used multiple real estate agents. They have no idea about this transaction, you know. And she's gone through multiple title companies. The real owner, Jane Smith, had to record a Liz pendants on the property, and that stops the sale of a property. So this person can't sell it, you know. And I'm hoping that no title company will just slip it through. But, yeah, that's a it's a real scary thing with fraudulent sellers out there. Wow.

It's good that you investigate to make sure nothing bad happens to the real seller. Definitely. Wow. And Alicia, if someone is not married when they purchase their home, and now that person is married today and wants to sell that same home. Does the spouse have to sign any paperwork at the title company?
Alicia Harworth 7:08
Yes. Whether you're married when you purchase a property and then you get married after, when you go to sell the property, your spouse will have to sign what's called a quit claim deed, or a spousal deed. They have to remove their interest off the property, because this is a community property, state, yes, once you're married, your spouse now has interest in in the home you own. So in order for you to sell it, they have to remove their interest off of the property,

okay? And let's say, for example, is there a way for a buyer or seller that lives overseas and cannot be here locally to sign their closing documents. Can they sign with a online mobile notary? Alicia,
Alicia Harworth 7:50
yes, there are requirements for an online mobile notary. You have to be a US citizen, you have to have four years of credit history, you have to have a computer with a camera, and you have to have an identification and email address. If you are not a US citizen, you do not have a credit history with the United States of America. There are hate convention countries where you can use an apostille notary. There's a list of those countries. And Canada, you can use what's called a barrister. They're a sort of attorney out in Canada. And then any country that's not on the Hague Convention or is not Canada, you can go to the US Embassy to sign all of your documents, but it does have to be in English, and it does have to be with a US notary.

Okay, good. Good to know. Very good to know, in case someone out there is having that situation. And Alicia, is it true that if you're an all cash home buyer, that you can, did it digitally sign online all your closing documents from anywhere and not need a notary? Yes,

that's that's true, at least with high court title. I can't speak with for other title companies. But if you have a cash transaction, there's nothing that needs to be notarized in our escrow documents for a buyer, for a buyer. So nothing needs to be nothing needs to be notarized. So you don't have to sign with a notary. You can sign electronically. Okay,

good to know. And what are the risks Alicia to not have a title company and escrow officer as part of the real estate transaction? Well,

you'll have to deal with fraudulent sellers. You might have someone that's selling you the property that's not authorized to do so, an ID to the naked eye. Sometimes, if you're not used to them, a bad ID, you just wouldn't know if it's if it's the correct person. Any liens, judgments, mortgages, any balances owed on a property, we pull a title report to know what needs to be paid off. So you, as a buyer, walks away free and clear. You know you there's no past judgments, and then we issue title insurance. So if you don't go through a title company, you have no insurance that your property is free and clear, and no insurance that you would have to pay someone's bills. That's,

that's, that would be really scary. Oh, my. Goodness and Alicia. What are some, let's say, real life horror story examples of what you have seen over the years where a buyer or seller did not use a title company and an escrow officer previously, and you and the title company, Tiger title now has to correct issues on the title because of that. Well,

unfortunately, if you don't use a title company, we can't correct issues. But I can kind of give you some warning we have it's exactly that, exactly what I talked about before. You can have someone that sold you a property that we've had people sell come in to sell a property. They have a contract, and they purchase a property from someone that wasn't the seller, or wasn't, you know, like a brother of a brother who sold a property underneath his brother, and now you cannot sell it. Or we've had transactions where the previous seller had $100,000 tax lien and a mortgage that wasn't paid off, delinquent HOAs liens judgments in their names, and now this new buyer is responsible to pay that off in order to sell the property, because the new buyer is promised to free and clear property, so you always want to go through a title company to be on the safe side. definitely, it sounds like it. And Alicia, what are some issues that come up when a seller is selling a home that's in a trust, and what general steps did you have to take to have the issues corrected? So
Alicia Harworth 11:33
if you're selling in a trust, I guess I just recommend that you have the correct trust paperwork. If it your trust paperwork has to be exactly how it's vested. Typically, if it's Alicia harworth Family Trust, it's going to be Alicia harworth Family Trust documents you need. Another problem that arises when it comes to trust is like deceased trustees. If you have a deceased trustee as a successor trustee, you can sell the property, but you have to have their death certificate. You have to have the full trust. If your trust is 100 pages, you got to have all 100. Those are typically things that that are missed when it comes to trust also. I mean, it doesn't matter if your property was vested in a trust 25 years ago, you have to have a copy of it. Okay,

good to know. And what are some issues that you had to deal with regarding, let's say, probate sales, and what general steps did you have to take to have the issue corrected?

Typically with probates, the problem that lies with there is timelines are not accurately communicated to buyers and sellers. Sometimes a probate can take 30 to 90 days to complete and to have approved. There's letters that have to be sent out, there's timeline waiting periods that have to happen, and sometimes that's not communicated with buyers and sellers. You have to just make sure you communicate that to your clients. And as a buyer and seller, you know that there might be a waiting period, but typically you're going to go through an attorney who does the paperwork accurately, and then the title company will have to approve all the probate paperwork I

see. I see good to know. And what are some issues that you had to deal with, let's say, regarding divorce sales, and what general steps did you have to take to have those kind of issues corrected
Alicia Harworth 13:20
when it comes to divorces. If you are divorced, whether your spouse is on title or not, you have to supply a divorce decree, because, like I said before, it's a community property state, so your spouse has interest in the property. One, when you get a divorce, you want to make sure your property is laid out in the divorce, who's to own the property after the divorce, who's allowed to sell the property after the divorce and how the proceeds are split, because your spouse could be entitled to money. And so we at the title company have to see that divorce decree so we know exactly what we need to pay out to your spouse or not. I see and if you're going through a divorce and it's not yet finalized, you want to just make sure you have you and your spouse are in agreement on how the proceeds are to be split.

I see, I see, that's good to know. And what is now, let me ask you this. Alicia, I know we only have 30 minutes, but what is the most bizarre escrow transaction issue that you had ever had to deal with, and how did you resolve that issue? This

one took me a while to think about, because I have had in 13 years, have had some very interesting transactions. Wasn't very interesting? Yes, yes. I think we've had some interesting

but one that kind of recently happened last year is there was a divorce couple, husband and wife. I opened a transaction. The wife was selling the property with a real estate agent, and my colleague, Tamara, who was in an office right next to me, opened the same property address with her husband, with a real estate agent. Did. Different real estate agent. So us working together so closely, we realized we had the same property address. And so each person decided they did not want to supply the divorce decree because they didn't. One was saying, Oh, I get the house. The other person saying, I get the house. But it's crazy. I mean, the arguments that was going on, the confusion happening. It was the it was a really crazy transaction. All in all, we finally got the divorce decree, and one of us has the escrow, and the other one had to cancel. So,

Also, I know there will be many California residents that may not have been affected by the wildfires, even, however, are just tired in general, from things happening there, like wildfires, earthquakes, mudslides and other things like the cost of living being so high. And so these California residents will be looking to make a major, permanent change of location. I would like to talk about where the Southern Nevada real estate market is headed for 2025 in regards to interest rates, 2025 can be a great year for many of you thinking of purchasing a home. This year, there are options of receiving a fixed below market interest rate that is below the going rate. Currently, there are some sellers that may offer an incentive to help a buyer to buy down the interest rate. There are new home communities even that can offer a rate, interest rate buy down, and if you're able to purchase now at today's interest rates, there is always the opportunity to refinance the rate when the interest rate goes down. However, if you're waiting for the interest rate to be lower before you purchase a home, you are now gambling on paying a higher price for that same style home in the future as the saying goes, marry the property and date the rate. So if you're able to purchase today, at least you're purchasing at today's price, instead of gambling with the prices being higher in the future. No one knows. No one knows an exact date for the interest rates to drop. However, you do have the opportunity to purchase at today's prices.
